Summary of Key Points
Your own photos: This B2C service is for processing photos that depict you. You may not upload or have processed photos of other people without their valid consent.
Business customers: For companies, HR, and team use we offer a separate B2B product with its own terms — please see our B2B Terms.
1. Scope: These terms apply to consumers using Profile Bakery for personal photo processing.
2. Services & Free Demo: AI-powered photo editing, background changes, clothing adjustments, quality improvement. A free demo feature may be available, which involves automated processing of uploaded photos via AI models. We do not use your photos for AI training. Demo photos are generally deleted after 48 hours. If retention is temporarily required to analyze and resolve technical bugs or errors, we may keep them for a short period and then delete them completely.
3. Pricing: See pricing page. Payment via Stripe only. All prices include VAT.
4. Contract Term: Monthly or annual depending on plan. Cancel anytime to end of term.
5a. Refunds & revisions (how we handle issues): We want your results to feel right for you. If something is off, contact us — we review each case fairly. Where we identify clear quality or technical issues on our side (e.g. obviously faulty output compared to what was shown at checkout), we usually offer a free re-run and may, where appropriate, consider a partial or full refund. This reflects how we work in practice; it does not replace statutory rights where they apply. If you cancel before production has started, we generally approve refunds; once production has begun, refunds are usually not the default, but we may still help in understandable cases. A further free run may be offered when reasonable — support@profilebakery.com. Please reach out within 7 days; we aim to respond within 14 business days. We do not refund for wrong or incomplete information you provided, or purely subjective preferences (e.g. taste), unless a point above applies.
Statutory withdrawal (legal framework): The bullets below describe how the statutory withdrawal rules work for digital services with immediate delivery. They do not limit the goodwill and case-by-case solutions described under 5a above.
- Statutory withdrawal expires when you agree to immediate performance and use credits (as explained at checkout)
- Purchased credits are generally not refundable after purchase; statutory claims and the approach in 5a remain unaffected
- After production has started, a statutory refund is usually not available — we may still review issues under 5a
- Subscription credits expire at month end — no automatic carry-over
- No automatic right to transfer or cash out unused credits
6. Usage Rights: You receive unlimited usage rights to generated images for all purposes.
7. Data Storage: Generated images deleted after 30 days (subject to change). You must download and save images yourself.
8. Warranty: AI results vary; we do not promise a specific aesthetic outcome. Statutory consumer rights apply. Where something is clearly wrong on our side, we aim to put it right as described under 5a — without creating a blanket duty to re-process every result.
9. Liability: Limited to intent, gross negligence, and personal injury. No liability for indirect damages, data loss, or platform unavailability. Limited to order value.
10. Applicable Law: Swiss law applies, mandatory consumer protection laws of your country remain unaffected.
11. Email communication and one-time offers: We may send you one follow-up email with an offer (e.g. discount code) if you entered your email in our B2C form but did not complete a purchase. Legal basis: legitimate interest. Each such email contains an opt-out link; you may also object by email to support@profilebakery.com.

Additional consent for free demo photos: To provide the free demo cost-efficiently, demo photos may be transferred to and processed by AI service providers and their subprocessors in third countries, especially the USA (including data centers operated by providers such as Google Cloud and Amazon Web Services). By uploading a demo photo and using the demo feature, you explicitly consent to such transfer pursuant to Art. 49(1)(a) GDPR.
